Is Abortion Legal in Ohio?
Yes. Abortion is legal in Ohio. In November 2023, Ohio voters passed Issue 1, adding the Right to Reproductive Freedom to the state constitution. This guarantees access to abortion care up until the point of fetal viability, as determined by a physician. After viability, abortion remains legal when, in the physician’s judgment, it is necessary to protect the life or health of the pregnant patient.
This amendment overturned older bans, including the six-week “heartbeat” law, which had been temporarily enforced after Roe v. Wade was overturned. In October 2024, a court struck down that ban as unconstitutional.
Across the United States, 63% of all abortions in 2023 were medication abortions — using FDA-approved pills such as mifepristone and misoprostol, which are typically taken up to 10 weeks of pregnancy.
